1. Acceptance of Terms

By engaging Blue Nose Aerial Imaging of Castle Pines, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. A signed Statement of Work governs each specific engagement and controls where it differs from these general terms.

2. Services Description

Blue Nose Aerial Imaging of Castle Pines provides commercial drone data services including aerial mapping and photogrammetry, thermal inspection, LiDAR, and multispectral analysis. We are an independently owned and operated business based in Castle Pines, Colorado. All flights are conducted under FAA Part 107 by a certificated remote pilot.

3. Quotes, Scope, and Scheduling

Quotes are valid for 30 days and are confirmed in a signed Statement of Work prior to mobilization. A 50% deposit is required to schedule. Flights are subject to weather, airspace authorization, and safe operating conditions; weather or safety cancellations are rescheduled at no additional charge.

4. Pricing and Payment

All prices are in USD and exclusive of applicable sales or use taxes. The deposit is non-refundable within 48 hours of a scheduled flight; a full refund is available 5 or more business days prior. The balance is due within 15 days of final invoice. Late balances accrue 1.5% per month after 30 days.

5. Deliverables, Accuracy, and Survey Disclaimer

Deliverables are provided for visualization, measurement support, and decision assistance. They are not legal surveys and are not a substitute for licensed survey work where required by law. Blue Nose Aerial Imaging is not a licensed land surveyor; survey-grade certification, where needed, is provided by a partnered licensed surveyor. Accuracy depends on mission design, ground control, GNSS conditions, processing, and client-provided reference information.

6. Data Ownership and Confidentiality

Upon final payment, the client receives full usage rights to the delivered data. We retain project files for 90 days for re-delivery unless an extended retention plan is arranged. We treat client site data as confidential and do not share it except as needed to complete the project or as required by law.

7. Client Responsibilities

The client is responsible for providing site access, identifying known hazards, and obtaining any landowner permissions required for the work. The client must disclose any airspace, security, or safety sensitivities at the site prior to mobilization.

8. Limitation of Liability

Our liability for any claim is limited to the amount paid for the services giving rise to the claim. We are not liable for delays, losses, or damages caused by weather, airspace restrictions, equipment failure, or other circumstances beyond our reasonable control, nor for decisions made by third parties based on the deliverables.

9. Dispute Resolution

Disputes shall be resolved through binding arbitration in Colorado, and these terms are governed by Colorado law. Contact us at scott.wallace@bluenoseaerial.com for any concerns before initiating proceedings.
